Conditions of transportation

The most important thing is the satisfaction of our customers, that is why from Plus Ultra we inform you about the transport conditions.

Article 1: Definitions

When passengers buy a ticket for a Plus Ultra flight they formalize a transport contract with that airline to which the following general conditions apply:

Agreed scales

It refers to those places, with the exception of the places of departure and destination, established in the Ticket or indicated in the itineraries of the Carrier as scheduled stopovers in the passenger's journey.

Transport

It refers to the transport of passengers and luggage, from the place of embarkation to the place of disembarkation, such as it is defined in the Applicable Law.

Identification code of airline

It refers to the alphanumeric code of two or three characters that identifies the different air carriers.

Authorized agent

It refers to the passenger sales agent designated by the Carrier to represent it in the sale of air passenger transport for its services and, when authorized, for the services of other air carriers.

Luggage

It refers to the personal belongings that accompany the passenger related to the trip. Unless otherwise specified, they include both checked and non-checked baggage.

Applicable law

It refers to any International, EU and National standard that affects the air transport of passengers, baggage, cargo and mail, including but not limited to the Convention, or Council Regulation (EEC) No 2027/97 regarding the responsibility of the carrier in case of accident, dated October 9, 1997, modified by the 889/2002, of May 13, 2002 and by Regulation (EC) 261/2004 of the European Parliament and of the Council of February 11, 2004 by the one that establishes common norms on compensation and assistance to the air passengers in case of denial of embarkation and of cancellation or great delay of the flights, and repeals the Regulation (CEE) no 295/91 and in his case, the Law 48 / 1960 of Air Navigation dated July 21 with its modification of Royal Decree 37/2001 dated January 19.

Baggage stub

Refers to ticket parts related to the transport of checked passenger luggage, including a claim slip issued by the carrier to be attached to the ticket.

Carrier

Refers to Plus Ultra or any other air carrier that is committed to transporting passengers and to your luggage or to perform any other service related to said air transportation, which is applicable in accordance with the context of the provisions of these General Transportation Conditions.

Charter transportation

It refers to a transport carried out by a real transporter who, with the authorization of the carrier contractor (Charterer or Tour Operator), carries out the total or partial transport according to a charter contract.

Baggage check tag

Refers to the document issued by a Carrier attached to a specific piece of luggage billed for identification.

Baggage check-in period

It refers to the time limit specified by the Carrier within which the passenger must have completed the formalities of billing the luggage and receiving the boarding pass.

Conditions of the contract

Refers to the clauses contained in the ticket, or delivered together with it, or in the receipt-itinerary (printed itinerary), identified as such and including, by reference, these Conditions of Transport.

Community air carrier

It refers to Plus Ultra or any other carrier with a valid exploitation permit granted by a member country of the European Union, in accordance with Regulation (EEC) No. 2407/92 of July 23, 1992.

Confirmed reservation

It means that the passenger has a ticket that contains the indication that the reservation has been registered and confirmed.

Connection ticket

It refers to a ticket issued to one passenger in connection with another; together, both constitute a single transport contract.

Agreement

It refers to any of the following instruments applicable to the transportation contract:
  1. Agreement for the Unification of Certain Rules for International Air Transport, done in Montreal on May 28, 1999; and subsidiary.
  2. The Convention for the Unification of Certain Rules Relating to International Air Transport signed in Warsaw on October 12, 1929 (hereinafter referred to as the Warsaw Convention)
  3. The Hague Protocol of September 28, 1955, amending the Warsaw Convention
  4. The Montreal Protocols Nos. 1, 2 and 4 (1975), which complement the Warsaw Convention

Coupon

It refers to both the flight coupon and the electronic coupon, which authorize the passenger whose name appears to travel on the flight identified in it.

Hurt

Includes death, injury or bodily injury suffered by the traveler, loss, partial loss, theft or any other damage that occurs as a consequence or in relation to transportation or other services additional lent by the carrier.

Days

It refers to the calendar days, including seven days of the week, provided that, for notification purposes, the day on which the notice is sent is not taken into account, and that for the determination of the duration of the validity of the ticket is not taken into consideration the day of its issuance or the beginning of the flight.

Domestic flight

Refers to any flight departing and arriving in cities located within the territory of the same country or a single airspace, except those that have scheduled any stop in the territory of any other State.

International flight

Refers to any flight whose departure and arrival points are located in two different countries. In accordance with the Applicable Law, all flights departing and arriving in cities located within the territory of the same country are international if a technical stopover is scheduled in another country.

Electronic coupon

Refers to any electronic flight coupon or any other valid document registered and conserved in our database.

Electronic ticket

Refers to the printed itinerary issued by the carrier or on behalf of a carrier, to the electronic Coupon and, if applicable, a boarding document.

Flight coupon

It refers to the electronic coupon, and indicates the specific places among which the passenger has the right to be transported

Overwhelming force

It refers to extraordinary and unforeseen circumstances beyond the control of the passenger and / or carrier, whose consequences could not have been avoided even if all the measures had been taken caution due.

Passenger

It refers to every person, except the members of the crew, transported or to be transported in an airplane, according to a ticket.

Person with right to compensation

It refers to a passenger or any person with the right to make a claim on their behalf in accordance with the Applicable Law.

Passenger voucher passenger voucher

It refers to the part of the electronic ticket issued by Plus Ultra or in our name that is identified as such and that finally works in the power of the passenger. Security elements refer to any object or apparatus that, for safety reasons, can not be carried on board according to the Applicable Law.

Special Drawing Rights (SDR)

They refer to a unit of account established by the International Monetary Fund (IMF), whose value is determined periodically by said entity.

Scale

It refers to a scheduled stop on the trip at a point between the place of departure and the place of destination.

Rate

It refers to the prices of the published tickets, the rates and / or the related Transport Conditions of a carrier that must be presented when the corresponding authorities require it.

Ticket

It refers to the document called "Electronic Ticket" issued by Plus Ultra on our own, and includes or incorporates by reference the Contract Conditions, notifications and coupons.

Unchecked baggage

Refers to any passenger luggage that has not been checked in.

Article 2: Applicability


  1. Generalities

1.1.- These Conditions of Transport apply only to those flights or flight segments, in which our Designator Code is indicated in the ticket carrier's box for that flight or flight segment. 1.2.- These Transportation Conditions also apply to reduced rates and free transportation, except when Plus Ultra has otherwise provided in the Contract of Carriage or in any other contractual document. These Transportation Conditions must be interpreted in accordance with the Applicable Law and, unless contrary to the aforementioned Applicable Law, with the IATA agreements.
  1. Chartering operations
If the transport is carried out according to a charter agreement, these Transport Conditions are applied according to the terms indicated, by reference or in any other way, in the chartering agreement or in the ticket.
  1. Shared code
In the event that PlusUltra has an agreement with other carriers, according to Article 1, known as "shared codes" and under those agreements, even if passengers have a reservation with PlusUltray in the ticket box corresponding to the carrier, the name appears or the PlusUltra designator code, the flight can be carried out by another carrier.
  1. Law of obligatory application
These transport conditions are applicable unless they are in contradiction with the Law or the rates applicable by PlusUltra, in which case that Law or tariffs will prevail. In case any provision of these transport conditions is invalidated by the application of some of that Law, the other provisions will remain valid.
  1. Conditions prevail over regulations
Except when otherwise stipulated, these transport conditions will prevail even if they are in contradiction with any other regulations that PlusUltra may have regarding certain issues.
  1. Information on the identity of the operating company
PlusUltra will inform passengers about the identity of the operating airline (s) in the contracted air transport services.

Article 3: Tickets

  1. General disposition
1.1.- PlusUltra will only transport the passenger whose name appears on the ticket, who can be requested to present the corresponding identification (National Identity Document, Passport or equivalent). 1.2.- The ticket is non-transferable. 1.3.- Some tickets are sold at discounted prices, which may be partially or totally non-refundable. 1.4.- If due to force majeure in the terms indicated in Article 1 a passenger with a ticket that responds to the characteristics described in section (c) and that has not been used in any of its sections is prevented from making the trip, PlusUltra must transport it on some of its future flights provided that the passenger notifies PlusUltra immediately and presents the evidence justifying such force majeure. 1.5.- Passengers will not have the right to be transported on a flight unless they present the identification reliable and a valid electronic ticket has been duly issued in your name. 1.6.- If the passenger travels with a reduced fare or under special conditions, he must be able to Demonstrate those conditions or the basics of the discount at any time during the trip.
  1. Period of validity
2.1.- Except when the ticket, these conditions of transport or the rates, as defined in article 1, include any clause that may limit the validity of a ticket (in which case the limitation shall appear in the ticket), a ticket is valid during: 2.1.1.- One year from the date of issue, or 2.1.2.- Subject to the first trip made within one year from the date of issue, one year from the date of the first trip indicated on the ticket. 2.2.- When the passenger is unable to make the trip within the period of validity of his ticket because at the time he makes the reservation PlusUltra is not in a position to confirm it, the period of validity of said ticket will be extended or the passenger shall have the right to request reimbursement in accordance with the stipulations of Article 10. 2.3.- If after the start of the trip the passenger is prevented from continuing it within the period of validity of the ticket due to illness, we can extend the period of validity of the ticket until the date on which the passenger is able to travel, or until our first flight after that date, from the point at which the passenger restarts the trip in the available space in the class or the service that has paid. The passenger must present a medical certificate proving the inability to fly. When the electronic coupon that is still included in the ticket indicates one or more scales, the validity of said ticket can be extended up to three months from the date indicated in said certificate. In such circumstances, we will also extend the period of direct family members accompanying the traveler. 2.4.- In the event of death of a passenger during the journey, the tickets of the persons accompanying the deceased traveler can be modified by not applying the minimum permanence clause or by extending its validity. In case of death of a direct relative of a passenger who has started the trip, the validity of the ticket of the passenger and of the direct family members accompanying him / her may also be modified. 2.5.- To benefit from the modifications mentioned in the previous section (2.4) it is necessary to present a valid death certificate and the extension of the validity of the ticket will be for a period not exceeding forty-five (45) days from the date of death.
  1. Sequence and use of the coupon
3.1.-The ticket you have purchased is only valid for the transportation indicated therein from the place of departure to the final destination, with the intermediate stopovers that may have been agreed. The amount paid is based on the PlusUltra fare and covers the transportation indicated on the ticket. The ticket forms part of the PlusUltra Transport Contract with the passenger. The ticket will not be accepted and will lose its validity if the coupons are not used in the sequence specified therein. 3.2.- In case the passenger wishes to modify some aspect of the transport, he / she must previously contact PlusUltra. The fare for the new transport will be calculated and the passenger will be given the option to accept the new amount or to keep the original transport as it appeared on the ticket.In the event that the passenger requests the modification of some aspect of the transport due to force majeure, as defined in Article 1, he must contact PlusUltra as soon as possible and the company undertakes to make all reasonable efforts to transport the passenger to the next stop or to the final destination without making a new calculation of the fare. 3.3.- The passenger must be aware that, while some types of modifications will not result in a change in the rate, others, such as changing the departure point (for example, if the first segment / coupon has not been used) or the investment of the direction of the trip, can be translated in an increase of the price. Many fares are only valid on the dates and flights indicated on the ticket and in no case can they be modified; In case they are modified, an additional amount must be paid. 3.4.- Each flight coupon included in the passenger ticket will be accepted for transportation in the class of service, on the date and on the flight for which the seat has been reserved. When a ticket has been originally issued without specifying the reservation, the place can be reserved according to our rate and according to the availability of places in the requested flight.
  1. Name and direction
The PlusUltra name may appear on the abbreviated ticket through our designator code (F6 / PUE) or otherwise. The address of the PlusUltra will be considered as the address of the departure airport that appears on the ticket next to the first abbreviation of the PlusUltra name as indicated for the first segment of the PlusUltra flight on the itinerary receipt ("Travel information").

Article 4: Rates, taxes, duties and fees

  1. Price of the bill
The price applies only to transportation from the airport at the point of origin to the airport at the point of destination, unless otherwise indicated. Does not include ground transportation service between airports, and between airports and terminals in the city. It will be calculated in accordance with the rates in force on the date of payment of the ticket to travel on the dates and according to the itinerary indicated therein. In case the passenger changes the itinerary or the dates of the trip, this may affect the price that must be paid for the ticket.
  1. Iinerary
Unless otherwise stipulated in our Contract of Carriage or in any other contractual agreement, the price of the ticket applies only to the itineraries disclosed in relation to it. If there is more than one itinerary in the same price, the passenger can specify which one they prefer before issuing the ticket. If no itinerary is specified, Plouter is responsible for determining it.
  1. Taxes, duties and fees
The applicable taxes and duties that the passenger must pay are taxes imposed by governments or other authorities or airport operators. At the time of purchase of the ticket, travelers should be notified of taxes, duties and fees not included in the price, most of which will normally be indicated separately on the ticket. The taxes, duties and fees that apply to air travel change constantly and may be imposed after the date of ticket issuance. If an increase in the tax, duty or fee indicated on the ticket is produced in accordance with the applicable legislation, the passenger must pay the corresponding difference. Likewise, in the event that any tax, duty or fee that the passenger has paid to PlusUltra at the time of issuance of the ticket has been eliminated or reduced so that it no longer applies or must be paid a lower amount, the passenger shall have the right to claim reimbursement of the corresponding amount.
  1. Badge
The ticket price, taxes, duties and fees are paid in the currency of the country in which the ticket is issued, unless PlusUltra or our Authorized Agent indicate another currency, before or at the time of payment ( for example, because the local currency is not convertible). We can accept payment in another currency, according to our criteria.

Article 5: Reservation

  1. Reservation requirements
1.1.- PlusUltra or our Authorized Agent will register your reservation (s). If you request it, we will give you a confirmation of your reservation in writing. 1.2.- Certain rates may have conditions that limit or exclude your right to change or cancel the reservation.
  1. Ticket issuance time limit
If the passenger has not paid his ticket before the specified time limit as indicated by PlusUltra or its Authorized Agent, PlusUltra or its Authorized Agent can cancel the reservation and dispose of the corresponding place.
  1. Personal information
To the extent that the Applicable Law allows it, in order to make a reservation for transport, the passenger authorizes the carrier to keep all the personal data that has been provided to the carrier or its Authorized Agent for the issuance of the ticket, obtaining services auxiliary, the operation of luggage fraud detection systems and ticket counterfeit prevention / detection systems, facilitate immigration and admission requirements and make such data available to government authorities when requested. In addition, the carrier is authorized to transmit such data for the aforementioned purposes to its own offices, its Authorized Agents, the auxiliary services provider or the governmental authorities, regardless of the country in which they are located.
  1. Assignment of seats
PlusUltra will try to attend the previous reservation of places; however, it can not guarantee any particular place. PlusUltra reserves the right to assign or reassign seats at any time, even after boarding the aircraft, which may be necessary for operational or security reasons.
  1. Reconfirmation of reservation
5.1.- Successive or return reservations may be subject to reconfirmation within a specified time limit. When appropriate, the passenger will be notified of the need to reconfirm, indicating the manner and place in which to do it. If the notification has been made and the passenger does not reconfirm, PlusUltra can cancel the successive reservations and the return. In case the passenger notifies the carrier that he / she still wants to travel, and whenever there are seats on the flight, PlusUltra will readmit the reservation (s) and transport the passenger. If there is no available space on the flight, PlusUltra will make reasonable efforts to transport the passenger to their next destination or to their final destination. 5.2.- Passengers must check the reconfirmation requirements of any carrier, as defined in Article 1, who intervenes in their trip. When necessary, the passenger must reconfirm with the carrier whose airline designator code appears on the flight to which the ticket applies.
  1. Cancellation of successive reservations
If the passenger does not show up for a flight, Plus Ultra can cancel their return reservation or their subsequent reservations, except if the traveler has notified the carrier in advance.

Article 6: Baggage / boarding billing

1.- The deadlines for the check-in of the luggage are different in each airport and Plus Ultra recommends that the passengers inform themselves about it and respect them. In order to allow you to comply with all governmental formalities and exit procedures well in advance of the departure of the flight, the passenger will arrive at the check-in desk of the carrier's luggage and at the boarding gate within the time indicated by the carrier. .Plus Ultra reserves the right to cancel the reservation if the passenger does not meet the indicated baggage billing deadlines. Plus Ultra or its Authorized Agents will inform passengers of the deadlines for baggage check-in and boarding for the first flight. For subsequent flights in the case of passengers in transit, passengers must inform themselves of the check-in deadlines for baggage and boarding. Plus Ultra will not be responsible for the loss or expenses resulting from the breach by the passenger of the provisions of this article. 2.- If the passenger does not arrive on time at the luggage check-in counters or at the boarding gate or if he does not have the proper documentation in accordance with Article 13 and is therefore unable to travel, Plus Ultra can cancel the place that you have reserved in your name and dispose of it without any responsibility for Plus Ultra. 3.- When the flight coupon has not been withdrawn from the ticket at the moment in which the passenger receives his boarding pass at the baggage check-in counter, this flight coupon will remain in the possession of the passenger, who must present it when appropriate. embark.

Article 7: Denial and limitation of transport

  1. Right to refuse transportation
PlusUltra may refuse to transport for security reasons (in flight or police) or, at its reasonable discretion and at any point of boarding and / or connection, may refuse to transport passengers and baggage if they occur, or if we reasonably consider that may occur, some of the following situations: (a) The passenger does not comply with applicable laws, regulations or government regulations. (b) The transport of passengers and / or luggage may endanger or affect the safety and health or materially affect the comfort of other passengers or crew; (c) If the mental and / or physical state of the passenger, including the problems caused by the consumption of alcohol or drugs, is a danger or a risk to himself, to other passengers and / or to the crew or to the goods. of passengers or crew or PlusUltra; (d) The passenger has behaved incorrectly on a previous flight and PlusUltra has reason to believe that such behavior may be repeated; (e) The passenger has refused to submit to personal security control or baggage control, as stipulated in Articles 8/5 and 13/6, or if the passenger has refused to properly prove his identity; (f) The passenger has not paid the ticket price, taxes, fees or applicable fees; (g) The passenger does not appear to have valid travel documents, may try to enter a country where he / she may only be in transit or for which he / she does not have valid travel documents, has destroyed his / her travel documents during the flight or refuses to present them to the flight crew or shore personnel, against receipt, when requested, and / or has expired documents that do not meet the requirements or governmental or international regulations in force or that are false, either for usurpation of identity or falsification of documents; (h) The plane ticket presented: (h1) It was acquired illegally or was purchased from a company that is not PlusUltra or any of its Authorized Agents; or (h2) There is information that it is a lost or stolen ticket, or (h3) It is a false bill; or (h4) Has a flight coupon that has been modified by someone who is neither, nor any of its Authorized Agents or has been maimed (i) The passenger has not complied with the requirements established in Article 3/3 regarding the sequence and use of the coupon; (j) At the time of check-in of baggage or boarding, the passenger asks the carrier for special assistance that had not been previously requested and confirmed; (k) The passenger has not respected any of the applicable instructions and provisions related to safety issues; (l) At the time of presenting the airline ticket, the passenger can not prove that it is the person whose name appears in the "Name of the passenger" box; In cases (g), (h), (i) and (l) PlusUltra reserves the right to keep the passenger's ticket.
  1. Special assistance
2.1.- Acceptance of the transport of unaccompanied minors, disabled passengers, pregnant women, sick people or other persons requiring assistance is subject to prior agreements with PlusUltra. Passengers with reduced mobility who, at the time of purchasing the ticket, have notified PlusUltra of their disability or any special request they wish to make to the company and have obtained the acceptance of PlusUltra will not be denied transportation due to such disability or special request. 2.2.- If the passenger needs PlusUltra to serve him / her a special meal on board his / her flight (s), he / she must request it at the time he / she makes or changes a reservation or within the period of time indicated by PlusUltra. Otherwise, it will not be guaranteed that such food is available on board of the corresponding flight (s). Due to operational conditions, it may not be possible to have some special meals, in which case we assume no responsibility to the passenger. 2.3.- It is suggested to passengers with health problems that they consult a doctor before making an airplane trip, particularly when it comes to long-haul trips, and that they take all appropriate precautionary measures. Special assistance under the terms of Section 2 is not part of the Transportation Contract and should be considered as an additional service under the terms of Article 12. In addition, if passengers make any request under the special conditions mentioned in the sections ( a) or (b) of point 2 only at the time of baggage check-in, PlusUltra will not assume any responsibility if it does not comply with or can not comply with said request and reserves the right to refuse boarding according to the terms of section 1 ( j) of this Article.

Article 8: Baggage

  1. Baggage allowances
Passengers can carry baggage free of charge according to the limitations and conditions contained in these Conditions of Transport, which they can request from PlusUltra, and under the conditions of the applied rate.
  1. Excess baggage
Passengers must pay an extra fee for the transport of the luggage that exceeds the allowance admitted according to the rates applied by Plus Ultra, available in Plus Ultra or its Authorized Agents.
  1. Objects that are not accepted as luggage
The passengers should not include in the luggage: (a) Objects liable to endanger the safety of the aircraft, persons or property on board the aircraft as specified in the Regulations on Dangerous Goods of International Civil Aviation Organization (ICAO), in the regulations of the International Air Transport Association (IATA) and PlusUltra regulations applicable to passengers (if requested, PlusUltra can provide more information in this regard); (b) objects that are prohibited by applicable laws or regulations of the country from which or to which they are flown; (c) objects whose transport Plusultra considers reasonably inadequate because they are dangerous or unsafe due to their weight, size, shape or character, or that are fragile or perishable taking into account, among other things, the type of aircraft used. If requested, PlusUltra can provide information about the objects that are not accepted. (d) Transportation is prohibited as baggage for firearms and ammunition that will not be used for hunting or sporting purposes. Checked baggage can be accepted for firearms and ammunition that will be used for hunting if unloaded and with the safes on and properly packed. The ammunition transportation is subject to the ICAO and IATA Dangerous Goods Regulations, as specified in the previous section (a); (e) Weapons such as old firearms, swords, daggers and similar objects may be accepted as checked baggage, according to PlusUltra criteria, but it is not allowed to carry them in the plane's passenger cabin. (f) Fragile or perishable objects, money, currency, jewelry, works of art, precious metals, silverware, titles or other valuables, costly items, optical and / or electronic devices, cameras of all kinds, musical instruments, boxes of tools, business documents, negotiable securities, passports and other documents, samples and actions, as well as any valuable item; (g) Live animals, except pets and in accordance with the application to date of the provisions included in section 10 of this Article; If, despite being prohibited, the passenger's luggage includes any of the objects mentioned in subsections (a) to (f) of this point, PlusUltra assumes no responsibility for any loss or damage affecting those objects that it is not included in the current provisions included in PlusUltra's liability regime, as defined in Article 15.
  1. Right to refuse transportation
4.1.- If at any point of embarkation or intermediate point PlusUltra discovers any of the objects described in section 3 as prohibited for transport as luggage, you can refuse to transport it. 4.2.- PlusUltra may refuse to transport as luggage any object that it reasonably does not consider fit to be transported due to its size, shape, weight, content and character, for security or operational reasons, or for the comfort of the other passengers. If requested, you can provide information about objects that are not accepted as baggage. 4.3.- PlusUltra may refuse to accept baggage for transport, unless, in our reasonable judgment, it is packed in an appropriate and safe manner in appropriate containers. If requested, we can provide information about packaging and containers that are not acceptable.
  1. Right to register
For security reasons, PlusUltra can request passengers to allow a registration or examination of their person or their luggage. If the passenger is not present, you can proceed to register your luggage in your absence for the purpose of determining if it contains any of the objects described in Section 3 as a firearm, ammunition or other weapon that has not been presented to PlusUltra . If the passenger is not willing to comply with this requirement, PlusUltra may refuse to transport the passenger and their luggage. In the event that the registration or other type of examination causes damage to the passenger and his luggage, PlusUltra will not be responsible for them, unless they are attributable to a fault or negligence on his part.
  1. Checked baggage
6.1.- At the time of delivery to PlusUltra of the baggage that the passenger wishes to invoice, PlusUltra will assume custody of it and will issue a luggage identification tag for each piece of checked baggage. 6.2.- Checked baggage must have the passenger's name or any other personal identification attached. 6.3.- Whenever possible, checked baggage will be transported in the same plane in which the passenger is traveling, unless PlusUltra decides, for operational or safety reasons, to transport it on an alternative flight. If the checked baggage of the passenger is transported on a subsequent flight, PlusUltra will deliver it to the passenger, unless the applicable laws require that the passenger is present for customs clearance. 6.4.- Regardless of the maximum limit allowed in the excess or excess baggage transported, the maximum weight per piece billed is 32 kg (except for certain special baggage)
  1. Checked baggage
7.1.- PlusUltra can specify the maximum dimensions and / or the weight of the luggage that the passengers carry on the plane and / or limit the amount of luggage, currently having the limitations of a maximum weight of 8 Kgs.   1. Collection and delivery of checked baggage
9.1.- In accordance with section 6 (c), passengers must pick up their equipment as soon as it is available at the place of destination or scale. In case the passenger does not collect their luggage within a reasonable time, PlusUltra can charge a reasonable amount for the deposit. In the event that the baggage is not claimed after six (6) months from the moment it is available, PlusUltra can dispose of it without assuming any liability to the passenger. 9.2.- Only the person in possession of the ticket and the identification tag of the luggage will be authorized to collect the checked baggage. 9.3.- If a person claiming the baggage is not in a position to present the baggage receipt and to identify it by means of the corresponding identification card, PlusUltra will deliver the baggage to said person only with the condition that it accredits, to the entire satisfaction of PlusUltra, the right to withdraw it. If PlusUltra so requests, said person must provide the adequate coverage to indemnify it for any loss, damage or expense incurred by the company as a consequence of that delivery.
  1. Animals
If PlusUltra accepts to transport animals, the transport of them will be subject to the following conditions: (a) Passengers must ensure that animals such as dogs, cats, domestic birds and other pets are properly caged and have valid health and vaccination certificates, entry permits and other documents required by the countries of entry or transit; In case the required documents are not presented, the transport of said animals will not be accepted. This transport may be subject to the additional conditions specified by PlusUltra and available upon request; (b) If accepted as baggage, the animals, along with their cage and their food, will not be included in the passenger's baggage allowance, but will constitute an excess of baggage for which the passenger must pay the applicable fare for that passenger. concept; (c) Service animals, together with their cage, accompanying passengers with reduced mobility will be transported free of charge, incorporated into the normal baggage allowance in accordance with the conditions specified by PlusUltra, available if requested; (d) When the transport is not subject to the liability regulations of the Applicable Law PlusUltra will not be responsible for the injuries or loss, illness or death of an animal that it has agreed to transport, unless the company has incurred negligence. (e) PlusUltra will not assume any responsibility for any animal that does not have all the exit, entry, health and other documents necessary for entry or transit of said animal by any country, state or territory, and the person that carries the animal must reimburse PlusUltra for any fine, cost, loss or liability reasonably imposed or incurred by PlusUltra as a result.

Articles 9: Schedules, delays, cancellations of flights

  1. Schedule
Before PlusUltra accepts the advance reservation by the passenger, the passenger will be notified of the scheduled flight time in effect at that moment and that time will appear on the ticket. It is possible that PlusUltra may need to change the scheduled flight time after the ticket is issued. If the passenger provides PlusUltra with contact information, the company will take care of notifying him of said changes. If after the passenger has bought the PlusUltra ticket, he introduces a significant change in the time of scheduled flight that the passenger does not accept and PlusUltra is not able to sell you a ticket in an alternative flight that is acceptable to you, the passenger has the right to claim a refund in accordance with article 10/2.
  1. Cancellation of successive reservations
2.1.- PlusUltra will take all the necessary measures to avoid delays in the transport of passengers and luggage. In the application of these measures and in order to prevent the cancellation of a flight, in exceptional circumstances PlusUltra may arrange for a flight to be operated on your behalf by a carrier, in accordance with the terms of Article 1, or provide other means of transport. 2.2.- Without prejudice to the provisions of the Applicable Law, if PlusUltra cancels a flight, does not perform the flight reasonably according to the schedule, does not leave the passengers at the places of scale or destination, or is responsible for passengers to lose a connection flight for which they had a reservation confirmed by a single Transport Contract, PlusUltra, at the passenger's choice, will take care of: 2.2.1.- transporting passengers, at the first opportunity presented, on another scheduled PlusUltra flight where seats are available, without additional charge and, when necessary, extending the validity of the ticket; or 2.2.2.- within a reasonable period of time, change the itinerary of passengers to the destination indicated on their ticket by air transport of the PlusUltra itself or a carrier, as defined in Article 1, or on the other means and class of transport mutually agreed, without additional charges. If the ticket price and modified itinerary fees are lower than the refund value of the ticket or the applicable part thereof, we will refund the difference, or 2.2.3.- We will make the reimbursement in accordance with the provisions of Article 10/2. 2.3.- In accordance with the provisions of the Applicable Legislation, especially reference to Regulation261 / 2004, in the event of cancellation of your flight delay exceeding two hours, the passenger may request the billing document or the boarding gate in which your rights are listed.
  1. Denial of boarding compensation for "overbooking"

Article 10: Refunds

  1. General conditions
PlusUltra will reimburse any ticket or part of it not used in accordance with the applicable price norms or rates, as follows: (a) Except for what is stipulated in this Article, PlusUltra must reimburse the person whose name appears on the ticket or the person who paid it against the presentation of a satisfactory proof of said payment; (b) If a ticket has been paid by a person who is not the one whose name appears on the ticket and if the ticket indicates that there is a limitation for the refund, we will reimburse only the person who paid the ticket or the order of that person; (c) If a reimbursement is made to a person who presents a passenger coupon and all unused flight coupons and that is not the person to whom the reimbursement must be made in accordance with the provisions of the previous subsections (a) or (b), it will be considered an adequate refund and PlusUltra will be exonerated of all responsibility and of any subsequent refund claim.
  1. Involuntary refund
If PlusUltra cancels a flight, does not make a flight reasonably according to the scheduled time, does not leave the passenger at the destination or scale or is responsible for the passenger losing a connecting flight for which he had a reservation under a Only Transport Contract, the amount of the refund will be: (a) If no part of the ticket has been used, an amount equal to the price of the ticket that has been paid; (b) If a part of the ticket has been used, an amount not less than the difference between the price of the ticket paid and the price applicable for the trip between the points for which the ticket was used. Unless the flight no longer has reason to be in relation to the travel plan, in which case the amount of the ticket price that has been paid will be refunded.
  1. Voluntary reimbursement

5.1.- Under the Applicable Law, PlusUltra reserves the right to make a refund in the same way and in the same currency used for the payment of the ticket. 5.2.- If PlusUltra accepts a refund in another currency that is not the currency of payment, said reimbursement will be made at (a) the exchange rates (s) and in the conditions established by PlusUltra.
  1. Who reimbursed the ticket
Refunds will only be made by the carrier that originally issued the ticket or by its agent, in case you are authorized to do so.

Article 11: Behavior on board the aircraft

  1. If, according to our reasonable criteria, the behavior of the passengers on board jeopardizes the safety of the airplane or that of any person or property on board, it hinders the performance of the crew in the performance of their duties or does not conform to the instructions of the crew, including, but not limited to, the instructions regarding the prohibition of smoking or the consumption of alcohol or drugs, or cause discomfort, inconvenience, damage to injuries to passengers or crew, as well as any property, PlusUltra can take the measures it considers reasonably necessary to prevent the continuity of such behavior, including coercive measures. Passengers can be disembarked at any point, denied transportation on other flights, and a legal action can be brought against them for infractions committed on board the aircraft.
  2. For safety reasons, PlusUltra will prohibit or limit the use on board the aircraft of electronic equipment, including, but not limited to, mobile phones, laptops, portable recorders, CD players, portable radios, electronic games or transmitting devices, toys controlled by radio and walkie-talkies. The use of hearing aids and pacemakers is allowed.

Article 12: Agreements to provide additional services

  1. In accordance with the Applicable Law and if in the course of the formalization of the Air Transport Contract PlusUltra also agrees to reach agreements with third parties to offer passengers other services than air transport, or if PlusUltra issues a ticket or a voucher related to transportation or services (other than air transport) to be provided by third parties, such as hotel reservations or car rental, in doing so PlusUltra acts only as an agent. The terms and conditions of the third parties that provide these services will be applied and PlusUltra will not accept any responsibility for the non-fulfillment in the provision of said additional services.
  2. If PlusUltra provides surface transportation, other transport conditions and, especially, other liability regimes may apply. If requested, said transport conditions and / or said liability regimes will be facilitated by the carrier that deals with providing the surface transportation service.

Article 13: Administrative formalities

  1. General conditions
1.1.- Passengers are responsible for obtaining all travel documents and all necessary visas to comply with all applicable laws, regulations, ordinances, travel requirements and visas or authorizations by states or countries from, to or from through which it flies; All passengers, including passengers in transit, must comply with the requirements of the states or countries related to immigration and border control. 1.2.- PlusUltra will not be responsible for the consequences for passengers derived from not obtaining said documents or visas or from non-compliance with the requirements mentioned in the previous subsection (a).
  1. Travel documentation
2.1.- Prior to the trip, at the request of PlusUltra, passengers must present all the exit, entry, transit, health and other documents required by laws, regulations, ordinances, provisions or other requirements of the states. or countries concerned and allow PlusUltra to make copies or keep copies of them. 2.2.- PlusUltra reserves the right to refuse transportation if the passengers have not complied with the requirements mentioned in the previous sections or if the travel documents do not seem to be in order.
  1. Denial of entry
Passengers who are denied entry to any state or territory will be responsible for paying any fine or charge that said state or territory imputes to PlusUltra and the cost of transportation from that state or territory. The price of the ticket for transportation to the point where passengers have been denied entry will not be reimbursed by PlusUltra.
  1. The passenger will be responsible for the payment of fines, detention costs, etc.
If PlusUltra is required to pay or deposit any fine or penalty or if it must incur any expense as a result of the voluntary or involuntary breach by the passenger of the laws, regulations, ordinances, provisions or other requirements of the states or territories , or the failure to present the required documents, the passenger must reimburse PlusUltra, at the request of the latter, for any amount paid or deposited and any expenses incurred for that reason. PlusUltra can apply to that payment or expense the value of any unused passenger transport ticket or any refund in favor of the passenger in our possession.
  1. Customs inspection
If required, passengers must be present during the inspection of their baggage, checked or unchecked, by Customs officials or other government officials. PlusUltra will not be liable to passengers for any loss or damage suffered in the course of such inspection or for the breach of these requirements by the passenger.
  1. Security inspection
Passengers and / or their baggage must undergo all security checks carried out by government officials, airport authorities and any carrier involved, or by PlusUltra, as established in Article 1.

Article 14: Successive transporters

For the purposes of the Applicable Law, transportation that must be carried out by several successive carriers under a single ticket or a connecting ticket is considered as a single operation. It is understood that each carrier is responsible only for the transport carried out on his account. However, you must take into consideration what is stipulated in Article 15.1.c (i).

Article 15: Liability for damages

  1. General considerations
The liability of PlusUltra and that of any carrier, in accordance with Article 1, will be determined by the Transportation Conditions of the carrier issuing the ticket, unless otherwise stipulated. As regards PlusUltra, the responsibility will be as follows: (a) Transportation is subject to the rules and limitations relating to the liability established by the Applicable Law. (b) Except for public and social insurance or similar bodies or any part subrrogada in accordance with applicable laws, PlusUltra agrees to waive any limitation of liability in case of death, injury or any personal injury suffered by a passenger, if the accident, in accordance with the Applicable Law, took place on board the aircraft or in the course of any embarkation or disembarkation of passengers as provided by the Applicable Law. (c) To the extent that the foregoing does not conflict with the content of these Transportation Conditions and without prejudice to the provisions of the Legislation in force: (i) With respect to checked baggage, passengers will be entitled to take action against the first and last carrier related to the air travel or with any other carrier operating a segment of the intermediate flight and it is shown that it was there that the passenger was transported. damage, destruction or delay of said luggage; (ii) The liability shall be limited to the damages shown and in no case shall PlusUltra be liable for indirect damages, as well as any form of non-compensatory damages; (iii) PlusUltra is not liable for any damages resulting from your compliance with the laws, governmental regulations, ordinances or requirements, or for breach of them by the passenger; (iv) PlusUltra is not responsible for damages that affect unchecked baggage, unless they are due to our negligence according to the evidence presented by the passenger; (v) PlusUltra will not be responsible for any illness, injury or disability, including death, attributable to the passenger's physical or mental state or due to the aggravation of said state; (vi) The Contract of Carriage, including these Conditions of Carriage and the exclusions or limitations of liability, applies to the PlusUltra Authorized Agents, to the officers, employees and representatives, to the same extent as it applies to PlusUltra. The sum recoverable by PlusUltra and the Agents, employees, representatives and authorized persons will not exceed the amount corresponding to PlusUltra's liability, if any; (vii) Any liability that PlusUltra may have for any negligence on the part of the passenger that causes or contributes to the damage will be reduced or even exonerated in accordance with the Applicable Law; (viii) None of these Transportation Conditions will void any exclusion or limitation of liability of PlusUltra, in accordance with the applicable Applicable Law.
  1. Provisions applicable to both international and domestic flights
2.1.- Bodily injuries: 2.1.1.- In accordance with the Applicable Law, PlusUltra will be liable for damages suffered in the event of death or injury or any other bodily injury suffered by the passenger if the accident that caused the damage suffered occurred on board the aircraft or during any of the passenger embarkation and disembarkation operations, according to the Applicable Law, and without prejudice to PlusUltra's exclusions of liability that are indicated below; 2.1.2.- However, PlusUltra's liability may be reduced or it may even be exonerated for the damage suffered, if the company demonstrates that: the death, the injuries or any other bodily injury were due to the state of health, physical or mental, of the existing passenger before the boarding operations of the passengers; or the damage, according to subsections (a) (i) of this section, was caused or favored by the passenger's negligence or by his health condition prior to the flight's boarding. 2.1.3.- There is no fixed economic limit for liability in the event of injury or death of the passenger. For damages of up to 113,100 SDRs (approximately 123,122 euros), the airline can not contest claims for compensation. Above this amount, the airline can only challenge a claim if it can prove that there was no negligence or other negligence on its part or that the damage was solely due to negligence or other wrongful act or omission of a third. 2.1.4.- Sum recoverable for the damage: • The recoverable sum will cover the repair of the damage, as determined in a friendly solution, as determined by the opinion of an expert or a competent court; PlusUltra will compensate the passenger for compensatory damages recoverable only and for the part that exceeds any payment received from any public social insurance agency or other similar institution. 2.1.5.- PlusUltra reserves all the rights to appeal against third parties, including, without limitations, the rights of subsidy and compensation; 2.1.6.- In case of death, injury or bodily injury as a consequence of an air accident, according to the Applicable Law or Section 2 (a) (i) of this Article, to the person (s) entitled to compensation, when you are (are) identified, you will be offered a prepayment to cover your immediate needs. In case of death, said advance payment shall not be less than the equivalent in EUROS of 16,000 SDR (approximately 17,418 euros) per passenger. In accordance with the Applicable Law at present, the advance payment will be made within fifteen (15) days following the verification of the identification of the persons with right to compensation and will be deductible from the final amount to pay for liability in accordance with this section (a). 2.2.- Delay: 2.2.1.- Characteristics of the compensable damage: • The delay as such is not a cause of injury: only the direct damage will be compensable, excluding any indirect damage or any form of non-compensatory damage; Passengers must demonstrate the damage caused by the delay; 2.2.2.- Scope of liability: • PlusUltra will not be liable for damages caused as a result of a delay if the company demonstrates that it has taken all the necessary measures to avoid it or that it was impossible for it to take such measures; • PlusUltra will not be responsible for the damages caused by a delay caused by the passengers or to which the passengers have contributed; 2.2.3.- Scope of the compensation: • The sum of the compensation is determined by the damage according to the evidence presented by the passenger and is included within the limitations contained in the Applicable Law (up to 4,694 SDR -approximately 5,110 euros-) • In case of delay in the delivery of checked baggage, PlusUltra, can, by means of a lump sum, compensate passengers for their expenses of first necessity caused by the delay when it occurs outside the place where the passengers reside in the present. 2.3.- Baggage: 2.3.1.- Exclusions of liability: • PlusUltra will not be responsible for baggage damages if these are caused by the belongings contained therein. If the passenger's property causes injury to another person or damages the property of another person or the property of PlusUltra, the passenger must compensate PlusUltra for all losses incurred and for the expenses incurred by PlusUltra as a result; • a PlusUltra does not assume responsibility for the transport of certain types of fragile or perishable objects • a PlusUltra will not assume any particular responsibility other than those that correspond to it according to what is stated in the following subsection (ii). 2.3.2.- Amount of compensation: Baggage delays In case of baggage delay, PlusUltra will be liable for the damage provided that it has not taken all reasonable measures to avoid the damage or it has been impossible for it to take such measures. The liability in case of baggage delay is limited to 1,131 SDRs (approximately 1,231 euros). Destruction, loss or damage of luggage to PlusUltra will be responsible in case of destruction, loss or damage of luggage up to the amount of 1,131 SDRs (approximately 1,231 euros). With respect to checked baggage, it is liable even when it is exempt from fault, unless the baggage was already damaged. With respect to unchecked baggage, the airline is only responsible for damages caused by its fault.

Article 16: Time limitation for claims and actions

  1. Claim notification for luggage
1.1.- Acceptance of baggage by the person in possession of the baggage claim without any complaint at the time of delivery is sufficient proof that the baggage has been delivered in good condition and in accordance with the Contract of Carriage, unless the passenger proves otherwise. 1.2.- In accordance with the Applicable Law, no action will be taken for damages, even if founded, with respect to checked baggage unless the passenger files a complaint with PlusUltra. If the passenger wishes to file a claim or initiate an action regarding damage to a checked baggage, he must notify PlusUltra or the Carrier, in accordance with Article 1, as soon as he discovers the damage and, as a maximum term, within seven days. (7) days, or in case of a delay, of twenty-one (21) days from the date on which the luggage was placed at your disposal. If no claim is received by the affected passenger within the time limits stated above, the passenger will lose his right to any legal action. 1.3.- As for PlusUltra, receive a claim for any loss or damage, submit a Property Irregularity Report (PIR) with reservations, if necessary. This Property Irregularity Report shall not be considered as a claim for the purposes stipulated in section 1.b) of this article.
  1. Limitation of actions
The right to any legal action before the appropriate Courts shall prescribe within two years, from the arrival of the airplane to its destination, or from the day on which the airplane should have arrived.
  1. Limitation time
All the actions that are undertaken in accordance with the previous sections (1) and (2) must be carried out in writing and within the indicated period.

Article 17: Modification and cancellation
